In the context of providing a property for temporary residential use, the general terms and conditions of the vacation rental contract define the rights and obligations of the parties regarding the rental of the property by the owner to the tenant for the duration and under the conditions specified herein.

Article 1 – Duration of Stay

The rental is granted for a fixed period, specified in the contract, from the check-in date to the check-out date. The tenant signing this contract shall under no circumstances claim any right to remain on the premises after the end of the stay.

Article 2 – Reservations and Payment

The availability of the rental must be confirmed by the owner. The number of occupants and their identities must be specified at the time of booking (the property may only be used by these individuals and must not exceed this number for insurance purposes).

The reservation is effective upon receipt of a deposit of [30%] of the total rental amount, together with the signed contract and a copy of a valid ID or passport.

The balance must be paid no later than [10 days] before arrival.

The rental price includes all charges (water, electricity, heating, Wi-Fi, provision of household linens and bicycles). No disputes regarding the rental price will be considered after the contract is signed. Only the local tourist tax per day for persons over 18 must be paid on-site.

Article 3 – Cancellation Policy

3.1 – Cancellation by the Tenant

Any cancellation must be notified in writing to the owner.

  • If canceled more than [10 days] before the scheduled arrival, the deposit remains with the owner as a flat-rate cancellation fee.

  • If canceled less than [10 days] before arrival, or in the event of no-show, the full rental price remains due, unless the property is re-rented for the same period under the same conditions.

  • If the stay is shortened by the tenant, no refund will be granted unless agreed by the owner.

3.2 – Cancellation by the Owner

In the event of force majeure or the owner being unable to ensure the use of the property (accident, unforeseen unavailability, sale of the property, etc.), the owner reserves the right to cancel the reservation. In this case, all amounts paid by the tenant will be refunded without delay, without any additional compensation.

3.3 – Force Majeure or Exceptional Events

Neither party shall be held liable if the execution of the contract is delayed or prevented by force majeure (natural disaster, health crisis, administrative decisions preventing guests’ access, etc.).

In such cases, the owner will, if possible, offer to reschedule the stay or, failing that, refund the amounts paid, deducting any justified non-recoverable costs.

Article 4 – Arrival and Departure

The tenant agrees to arrive on the date and time specified in this contract. In case of late or delayed arrival, the tenant must inform the owner.
The tenant also agrees to vacate the property on the date and time specified in this contract.

Article 5 – Inventory and Condition of the Property

The property is rented furnished and equipped as described. An inventory will be jointly prepared and signed by the tenant and the owner or their representative upon arrival. This inventory serves as the sole reference in case of disputes regarding the condition of the property. The cleanliness of the property upon arrival must be noted in the inventory. Cleaning during the stay is the tenant’s responsibility; end-of-stay cleaning is provided by the owner.

All facilities are in working order. Any complaint regarding the property’s condition or inventory made more than 24 hours after arrival will not be accepted. Repairs needed due to negligence or improper use during the rental are the responsibility of the tenant or their family. No replacement of items other than identical replacements will be accepted at the tenant’s initiative.

Article 6 – Security Deposit

The tenant shall pay the owner a security deposit of [amount specified in the contract] to cover any potential damages, losses, or breaches of contractual obligations.

This deposit will be returned to the tenant within a maximum of [15 days] after departure, after deducting, if necessary, the amounts required to repair damages or replace missing items.

If damages, losses, or breaches exceed the deposit amount, the tenant expressly agrees, by signing this contract, to cover the full cost of damages by paying the difference to the owner within [15 days] of receipt of the corresponding documentation.

Article 7 – Use of the Property

The property is rented exclusively for seasonal residential use. Any commercial or professional activity is prohibited without prior consent (events). The tenant must ensure the peaceful use of the property and use it in accordance with its intended purpose. Children remain under the full responsibility of their parents or accompanying adults.

Article 8 – Occupancy Capacity

The maximum occupancy is specified in the contract and cannot be exceeded. If the number of tenants exceeds the allowed capacity, the owner may refuse additional occupants. Any modification or breach of the contract will be considered initiated by the tenant.

Article 9 – Access for Inspections and Technical Interventions

The tenant may not refuse access to the property for inspections or technical interventions when requested by the owner or their representative.

Article 10 – Pets

Pets are not allowed in The Beach House unless prior written approval is obtained from the owner.

If exceptional authorization is granted, the following conditions apply:

  • Only small to medium-sized pets (under [20 kg], non-aggressive and non-destructive) are allowed.

  • The tenant agrees never to leave the pet alone and unsupervised inside or outside the property.

  • The tenant must maintain cleanliness, including picking up pet waste in the villa and throughout the property.

  • The tenant is fully responsible for any damage, noise, or nuisance caused by the pet and agrees to indemnify the owner for any additional cleaning or repairs required.

Any serious breach of these obligations may result in immediate termination of the contract, without refund.

Article 11 – Tenant Obligations

By signing this contract, the tenant agrees to:

  • Occupy the premises with care, preserving the general condition of the property, furniture, equipment, and outdoor spaces.

  • Respect the maximum occupancy of six [6] people and not host additional persons without written authorization from the owner.

  • Use provided equipment (e.g., kayaks, dock) responsibly and according to their intended purpose.

  • Comply with the house rules, especially regarding neighborhood respect and prohibition of excessive noise.

  • Not organize parties, events, or gatherings without prior written consent from the owner.

  • Not sublet or transfer this contract to any third party.

  • Keep the property clean and in good condition throughout the stay and return it in its initial state. Standard cleaning is included, but excessive cleaning may be charged and deducted from the deposit.

  • Immediately report any damage, malfunction, or issue to the owner within 24 hours. Failure to do so implies acceptance of the property condition.

  • Secure the property by closing doors and windows when absent.

  • Comply with local regulations, particularly regarding environment, waste management, and recycling.

  • Take all necessary precautions when using the dock, kayaks, and outdoor installations.

Any serious breach may result in immediate termination of the contract without refund, without prejudice to any damages or compensation due.

Article 12 – Governing Law and Disputes

This contract is governed by French law. Any disputes will be brought before the competent court at the location of the property.

Any complaints regarding the property must be made within 48 hours of arrival by registered letter to the owner, with supporting documentation. Claims submitted after this period will not be considered.

Article 13 – Acknowledgment Clause

By signing this contract, the tenant acknowledges having read the house rules, the general terms and conditions of rental, and agrees to abide by them.
